Items to Check in the Employment Contract

1. Contract Period

Start Date of Work

  • Must be recorded from the date of part-time employment permit approval

Contract End Date

  • Ensure it is within the individual's visa expiration date

  • Caution: When extending a visa, Rewrite the employment contract and reapply for part-time employment permit needed

2. Match between Work Location and Actual Workplace

✅ Ensure the business address in the contract matches the actual store/office address where you will work

  • If the addresses are different, the part-time employment permit may be rejected during immigration review

✅ Confirm possible relocation of branch.

  • Check for the phrase "Placement at other branches if necessary."

  • If traveling between several branches, ensure it doesn't conflict with your visa rules (prohibition on working outside authorized locations); exclusion in the contract or a separate agreement is needed.

3. Working Hours

Must be stated according to the weekly working hours allowed by your visa.

4. Job Description

1. Must match the business category on the employer's business registration certificate.

If the job is restaurant service, a restaurant category must be included in the employer's business registration.

2. The job must be one legally permitted by your visa.

5. Salary

Check Amount

  • Ensure it matches the amount agreed upon with the employer in advance.

  • Pre-/post-tax amount: Confirm if the salary in the contract is before tax (pre-tax) or after tax deduction (post-tax).

Payment Date

  • Explicitly check the salary payment date (e.g., 10th of every month, every Friday).

  • Verify the method for handling payment delays (interest on delay, additional payments).

Payment Method

  • Check if the payment method is cash or deposit to an account.

  • In the case of account deposits, it must be documented in your name.

  • When using an account in someone else's name, prior agreement with the employer is mandatory. Note: this could lead to additional examination by the Immigration Office during the visa extension/change process for the other party.

Payment Responsible Party

  • The entity responsible for salary paymentMust verify if it is the same entity as the contract party (employer).

  • If the contract party and payment entity differ

  1. The contract must clearly state "Contract Party: Branch A / Salary Payment: Headquarters B Corporation" or similar.

  2. Both the contractual and payment entities must sign the contract (including corporate stamp).
